Terms and Conditions
Last modified: September 23, 2026
This Agreement outlines the terms and conditions of your enrollment in the programs offered by HealthyVue, LLC (“HealthyVue”) . HealthyVue operates the telehealth platform and provides administrative services. Independent licensed Providers and medical practices contracted by HealthyVue deliver patient care and exercise clinical judgment. Our Programs arrange access to personalized medical services tailored to your health goals. HealthyVue offers medical programs from time to time (“Programs”). The specific Program you select, its price, billing cycle, included services and access, and any separate charges are set out in the dated program description and pricing presented to and accepted by you before purchase (the “Program Details”), which forms part of this Agreement.
By enrolling in any of HealthyVue's Programs, you agree to be bound by the terms set forth in this Agreement, which governs your participation in the selected Program. It is important that you read and understand these terms as they outline both our commitment to you and your responsibilities as a participant in our Programs.
INITIAL NOTICES
NOT HEALTH INSURANCE. THIS AGREEMENT IS NOT HEALTH INSURANCE AND DOES NOT MEET ANY INDIVIDUAL HEALTH INSURANCE MANDATE THAT MAY BE REQUIRED BY FEDERAL LAW, INCLUDING THE FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT AND COVERS ONLY LIMITED ROUTINE HEALTH CARE SERVICES AS DESIGNATED IN THIS AGREEMENT.
1. HealthyVue's Program Fees
HealthyVue offers a variety of payment plans for its Programs, designed to accommodate the diverse needs and preferences of our clients. Options may include month-to-month memberships and one-time payment plans, among others. Specific details regarding the current payment plans available, including pricing and duration, can be found on our website or by contacting our customer service team.
Membership Programs renew automatically on the billing cycle stated in your Program Details until cancelled in accordance with Section 5. One-time services do not renew. Your Program Details state what your fee includes; medication, laboratory testing, shipping, and supplies are billed separately only where the Program Details say so, and any additional charge not included in your Program Details will be disclosed before it is incurred.
Payment Authorization. By purchasing a Program you authorize HealthyVue to charge the payment method you provide for the fees stated in your Program Details when they fall due.
Treatment-Cycle Programs. Some Programs supply medication in 90-day treatment cycles while charging a monthly Program fee. This paragraph applies only where your accepted Program Details expressly establish the treatment-cycle commitment and state its total price, the monthly payment amounts and due dates, and the included services and access. The total cycle price equals three consecutive monthly Program fees and includes the cycle's prescribed medication supply and the other services stated in your Program Details. The three payments begin with the monthly fee for the month in which the pharmacy dispenses that cycle's medication; fees already credited to that cycle reduce its unpaid balance. Once the medication for a cycle has been dispensed by the pharmacy, the unpaid monthly fees for that cycle remain owed if you voluntarily cancel, subject to the Refund Policy's corrections and non-performance provisions and applicable law. Cancellation does not eliminate an existing cycle balance, and the remaining fees continue to fall due on their original dates. If you believe medication was dispensed in error after a timely cancellation request, contact HealthyVue under the Refund Policy's corrections process. The next cycle begins when a provider authorizes it at your follow-up appointment and the medication for that cycle is dispensed; to avoid a new cycle, cancel before that medication is dispensed. If a balance remains after you cancel or withdraw your payment authorization, HealthyVue will invoice you for it.
Please note, once a payment is made, whether it's part of a membership or a one-time payment for program enrollment, it is subject to the terms of our non-refundable policy as detailed in the HealthyVue, LLC Refund Policy.
2. No Emergency Care; Certain Services and Items Excluded
If you have an emergency you must dial 911. HealthyVue does not treat emergencies. HealthyVue does not offer primary care medical services, and does not dispense medication. Prescriptions written by HealthyVue providers are filled and shipped by independent licensed pharmacies.
3. No Insurance Accepted; Self-Payment Only
The Program is a direct health care service; it is not health insurance. HealthyVue does not participate with or bill commercial health insurance plans or federal healthcare programs such as Medicare or Medicaid. HealthyVue providers may recommend you receive services not offered by HealthyVue (e.g., specialty services, diagnostic tests), but in no event will HealthyVue be responsible for any resulting medical bills.
You are solely responsible for payment of all fees for HealthyVue's services. If you do have health insurance, your insurance policy is a contract between you and your insurance company. It is your responsibility to know your benefits, and how they will apply to your benefit payments. HealthyVue takes no responsibility to understand or be bound by the terms and conditions of such insurance. There is no guarantee your insurance company will make any payment on the cost of the services you have purchased.
4. Appointments: Missed/Late Cancellations, Fees, and Maintenance Calls
Virtual Consultation: We are pleased to offer the initial virtual consultation at no cost. This session allows us to understand your health goals and outline how the HealthyVue program can support you in achieving them.
Cancellation or No-Show Fee: We understand schedules can change, which is why we request that you inform us as soon as possible if you need to cancel or reschedule your appointment. Please be aware that a $25.00 cancellation or no-show fee will be charged if you cancel a follow-up appointment within 2 hours of the scheduled appointment time or fail to attend it. This fee does not apply to the initial virtual consultation.
Maintenance Calls: For individuals interested in continuing their health journey with us after completing their initial program, we offer Maintenance Calls. These calls are designed to reassess your goals, adjust treatment plans as needed, and provide ongoing support for your continued success. Please note, Maintenance Calls come at an additional charge unless included in your Program Details, and that charge will be disclosed before it is incurred. For more information on costs and how to schedule these calls, please contact us directly.
5. Term and Termination
Term: HealthyVue may, in its sole discretion, not accept this Agreement and return your payment to you. If HealthyVue accepts the Agreement, the term of this Agreement will begin on the date HealthyVue receives your Membership/Enrollment Fee payment and last for the length of the Membership Term stated in your Program Details (“Term”).
Termination: Either you or HealthyVue may terminate this Agreement at any time, with or without cause, upon prior written notice. You may cancel by written or electronic notice to HealthyVue at support@thehealthyvue.com. Your cancellation takes effect at the end of your current billing cycle and stops future renewal charges. Installments already owed under a treatment-cycle Program (Section 1) remain payable on their original dates. You keep access to your Program through the end of the period you have already paid for, subject to the suspension and safe-care provisions below. No membership cancellation fee applies. If HealthyVue terminates this Agreement for reasons of safety, licensure, or its inability to provide the Program, HealthyVue will assist with transition of your care and refund any fees paid for services not provided. Further information about HealthyVue's cancellation policy is available at Refund Policy.
Missed Payments and Suspension: If a payment is declined or otherwise not received when due, HealthyVue may suspend your access to the Program, including consultations, prescription renewals, and shipments, until your account is brought current. No new membership fees accrue while your access is suspended; any balance already owed when the suspension began, including committed treatment-cycle installments, remains due on its original schedule. Suspension does not restrict your lawful access to your medical records or eliminate HealthyVue's obligations for appropriate clinical transition. A provider withholding a prescription on safety grounds while other Program services remain available is not, by itself, a suspension of the Program. If your account is not brought current within thirty (30) days of the start of the suspension, your Program is cancelled. HealthyVue reserves the right to charge a reinstatement fee of $15.00 when reinstating a suspended account. You may cancel at any time during a suspension in accordance with this Section.
Withdrawing Telehealth Consent: You may withdraw telehealth consent by telling your Provider or contacting HealthyVue at support@thehealthyvue.com or (850) 318-2858. Withdrawal stops further telehealth care when your Provider or HealthyVue receives it and automatically initiates membership cancellation; no separate cancellation request is required. Membership cancellation takes effect at the end of the current billing cycle and stops future renewals. Further telehealth care requires renewed consent. The paid-access language above does not authorize care after consent is withdrawn. Existing treatment-cycle installments, refund eligibility, and legal remedies remain governed by Section 1 and the Refund Policy. You retain your lawful records-access rights and appropriate care-transition assistance.
6. Electronic Communications
By providing your email address, you agree to receive electronic communications via email. If you have consented to text messaging in your intake forms, you also agree to receive care-related and administrative communications by text message (SMS); message and data rates may apply. Ordinary email and SMS can pose privacy risks. HealthyVue also provides a secure patient portal, which you may use for communications about your care. To select or change your communication preferences, contact support@thehealthyvue.com. These preferences do not waive HealthyVue's privacy and security obligations.
7. Privacy and Confidentiality
HealthyVue and its providers will maintain a record of the services they provide you, and will maintain the confidentiality of your medical information in accordance with applicable state law and federal law. The HIPAA Notice of Privacy Practices, available at https://www.thehealthyvue.com/privacy-practices, describes how HealthyVue and the subcontracted Providers/Practices handle clinical information within their respective roles and explains your privacy rights. HealthyVue handles information on the Practice’s behalf only as permitted by applicable law and agreements. The website Privacy Policy does not expand permission to use clinical information.
8. Your Location and Your Responsibilities
HealthyVue arranges access to care through contracted Providers and Practices in the states listed on our website, only when the treating Provider is legally authorized to provide that care in the state where you are physically located. You must tell us your actual location at each telehealth encounter and notify us if you move or travel. If care cannot lawfully be provided in your location, we will discuss available next steps, including transition of care when appropriate. Prescribing and treatment decisions are matters of your provider's clinical judgment in accordance with applicable law and standards of care; enrollment in a Program does not guarantee that any medication will be prescribed or that any result will be achieved, and your provider may require follow-up visits or laboratory testing to continue prescribing. Any additional charges not included in your Program Details will be disclosed before they are incurred. You agree to provide accurate and complete health information, to attend required follow-up visits, and to tell your provider promptly about changes in your health. You may decline any recommended treatment.
9. Entire Agreement; Amendment
This Agreement sets forth the entire agreement between the parties with regard to the subject matter hereof, and supersedes all prior or contemporaneous oral or written agreements. This Agreement may be amended only in writing signed by all parties. Notwithstanding the foregoing, HealthyVue may, upon at least ninety (90) days' notice to you, unilaterally amend the Membership/Enrollment Fees and Membership Payment Schedule at any renewal period of this Agreement and/or amend this Agreement if required by applicable law. Upon receipt of such notice, you may accept these changes or reject them by cancelling your Membership in accordance with Section 5 (Termination), effective at the end of your current billing cycle. A fee change never applies to a treatment cycle already in progress; for treatment-cycle Programs, a changed fee applies only if you agree to it before your next cycle begins. Your Program Details, this Agreement, and the Refund Policy are read together; the Program Details govern the price and contents of your Program, this Agreement governs enrollment and cancellation, and the Refund Policy governs refunds.
10. Miscellaneous
